Well Md, you might need to start by correcting your first statement. I am not aware of any announcement by AGS stating that a formal MDA was ever entered into. If you know of one please provide a link to it.

Part of the on going confusion and dispute is that the company seems to have informed shareholders that an initial mining area had been established but the parties are also in dispute over the extent of this area and its relation to the confidential dilution formula which presumably is contained in the original joint venture agreement JVA.

The unresolved issue surrounding the extent of the mining area and the each parties ongoing obligations to fund development "outside" of the disputed mining development area surely impacts the value of ACE and therefor the AGS share price.

There is no formal mining development agreement (MDA) as far as I know, so better that you don't use that term unless you can point me to an announcement by the company that states that they entered into one.
