"They further note that whereas rescission may be available to a contracting party in the case of fraud, undue influence or duress, completely setting aside the contract from its beginning, this is not available to Indigenous parties in relation to a registered agreement under the NTA where a future act has occurred, because the future act remains valid despite removal of an ILUA from the register."
