CHEMEQ SETTLES ASIC PROCEEDINGS
Chemeq Limited (ASX: CMQ) is pleased to announce that it has reached a settlement with the Australian Securities & Investments Commission (ASIC) in relation to ASIC’s proceedings against the Company pursuant to which it will acknowledge two contraventions of the continuous disclosure requirements of the Corporations Act.
All other ASIC allegations against Chemeq will be withdrawn. ASIC has advised that it will not take any further enforcement action against Chemeq or its directors, officers, agents or employees, past or present, based on information obtained in the course of its investigation and the proceedings.
As part of the settlement, Chemeq has agreed to pay pecuniary penalties, in an amount to be determined by the Federal Court. In addition, Chemeq has agreed to contribute $170,000 towards ASIC’s legal costs.
Chemeq’s Chief Executive Officer David Williams said Chemeq agreed to this settlement to avoid a long and costly trial.
“The Board and new senior management team can now direct all effort towards the Company’s commercialisation strategy,” he said.
“Chemeq remains committed to full and proper disclosure and we have in place strong public reporting procedures to ensure that Chemeq meets all its continuous disclosure obligations.”
