Justice Digby dismissed the application for an injunction and awarded costs against Aqueous. He said CDI was acting contractually lawfully. “There was no proper basis for an injunction,” he said. Outside the court, solicitor Dale Cliff, representing Mr McDonald said the application was “ill-conceived” and the result was as he had expected. “It’s all just rubbish,” Mr Cliff said. “She (Mrs Bevilacqua) should never have brought the application.” Mrs Bevilacqua’s solicitor Sam Bond said outside the court, the case had achieved an undertaking from CDI that no further demolition would occur without permission. “Really, Mr McDonald has given us what we set out in court to gain,” he said.
