YOW's decision to cut ties with Whetstone certainly leaves the door open for a competitor to take up the opportunity or Whetstone to produce their own product. But as was discussed on the other thread Yowie has a big first mover advantage now so if any small manufacturer or Whetstones wanted to get in they would have a lot of catching up to do.
It also begs the question, if all these manufacturers were desperate to get into this space why nobody took up the patent originally. Does anyone really think Whetstones wouldn't have shopped the rights to the patent around to all the big boys and established confectionary companies before entering into an agreement with a tiny Australian start-up? And according to the article Whetstones sold the patent rights to Kinder in 2004, they didn't enter the US market then so what makes anyone think they will enter now?
