Yes, thats pretty much how i see it. Worst case scenario is pay Whetstone royalty anyway if instructed by court, or per agreed settlement. Not really any worse off than they ever were while using Whetstone factory... But as I said, YOW are very aware of the patent issue and took great care with their lawyers to ensure there is no infringement so a ruling against them is very unlikely IMO.
