The greek lawyers (as opposed to the GREEKS) would not have taken the same action against Saddam for the same reason they are not taking action against the US. The US, Iraq, CHina and Israel do not recognise the juristiction of the Internatioanal Criminal Court.
And the juristiction of the court only commenced on 1st July 2002 which means for action to be taken against him there would have to evidence of him commiting a crime against humanity after this date and he would have to be in a country that had signed up to the court.
