I think it's just a hand-shaking continuation. Makes sense to have contracts in place like this in case 4DS don't hit their targets. It's more of a safety net for HGST than anything.
A catastrophic consequence to the SP will be if that contract doesn't get signed. However I don't think that's even a possibility worth considering at this stage. Milestone after milestone keep getting hit by 4DS.
Still trying to earn myself the spare capital to dump into 4ds.... Ugh, in time.. I better not miss the boat
