Created an expectation of big things to come "soon"? Define "soon". If the company is not meeting its targets, this doesn't substantiate a breach of duty of care, which is a fairly serious allegation to make.

If the persistent failure to report is resulting with shareholders selling up, then that's the price the company pays for its lack of performance. This is a speculative stock for a reason; there is no BAU, which makes it difficult to provide consistent reporting. I believe the company is providing updates in good faith, which is a key fault element for a breach.
