Because it was awarded to them in the first place so they are fighting it as they are pissed off but during the 5 year legal fight, no-one thought nickel price would drop to 5.5US/lb and then 5US/lb and then 4.5US/lb and then 4US/lb (where it stayed around 4-4.5US/lb for most of the last 12 month) and it even dropped to as low as 3.5US/lb!!!!!!

It looked very good back then in 2014 with 1.5% laterite nickel ore when AVQ was quoting it for 85US/lb (but has more then half since then), it very hard to get funds for start-up cost for commencing nickel production, given how low the nickel price is at (market was reporting 50-60% of nickel producer was still making a loss with nickel price at 5-5.5US/lb!!!!)
