Hello ASX,

Please pass on the to appropriate advisor for a response to my enquiry

On the 30^th August 2016 the company OBJ limited (OBJ) released an announcement to the ASX regarding its technology been incorporated into an Olay product (owned by the worlds larest FMCG company P&G) and will be released across China. This announcement was a significant one for OBJ Limited yet the ASX deemed the announcement as advertising and never published it. The technology in this announcement was no different to technology it has discussed and released in the past. If fact it is the same when OBJ incorporated it’s technology with Sk-II products (P&G again) yet the ASX allowed this announcement through (refer to OBJ announcement on the 30^th September 2014).

Now a week later on the 8^th September 2016 the company Nuheara Limited (NUH) released an announcement discussing the Apple iPhone 7 (Advertising) which is not incorporated into Apples technology, yet gets announced by the ASX.

Can you please explain why the OBJ announcement wasn’t allowed to be announced as it was deemed to be Advertising, yet an announcement from Nuheara manages to meet your criteria?

Announcements that are submitted to the Market Announcements Office are considered on a case-by-case basis as to whether they are appropriate for release on the Market Announcements Platform.

As such, ASX considers that the release of the Nuheara announcement to which you refer has no bearing on ASX’s decision not to release the OBJ announcement in question.
