I suspect PLS are the ones who have acted according to the rules of the ROFR. PLS have always been keen to have it resolved by an independent expert, so they must believe they have acted correctly. On the other hand, MIN are absolutely against such a move. They are trying to delay the agreement and the only way they can do that is through a long drawn out court proceeding. PLS are trying to avoid that delay.
It is rather surprising that we have not heard what eventuated on Friday, and that is what worries me. One must assume that NO independent arbitrator has been appointed.
