To me the scenario is very clear.
If everything is straight forward and there is nothing more than what we know in the public domain, the problem could have been solved by one announcement, "sorry FAR, that was an oversight, here is the rest of the documents; let's proceed as per the PE rules."
Why the reluctance to show us what was omitted? and why pay millions of dollars in lawyer fees and risk finger pointed at you?
Where there is smoke, there is fire. in this case, I think the fire is started in three fronts. AJIMHO.
