The requirement to hold an AGM is from Corporate Law and is an ASIC matter. A normal public company must hold an AGM within 5 months of the end of the financial year or ASIC can take the directors to court.
It is not relevant to EVM, as it is already suspended, but the ASX would automatically suspend any company that did not publish timely financial results or hold an AGM.
