I have sent a query to Nathan Ryan.
Specifically if the pipe in the trench leaked, is it a defect that SENET are responsible for and surely under such a contract, wouldn't SENET be obligated to repair. Even though Phase 1 SXEW was completed mid 2015, warranties for this should still be in force (provided their construction contracts are similar to ours).
The interesting thing is Public Liability cover. If this is required by the financiers (possible), can insurance be obtained in the DRC, if yes, you'd expect many carve outs (exclusions) for force majeur, civil strife, terrorism etc. But in this case, faulty plant, or even god forbid a fire, surely there may be possible relief from an insurance claim?
