As long as emh stays away from lmax, then this legal issue will not effect them. When lit sent out the letter stating this issue a few months ago, I jumped out of emh, as at that time all the numbers from the scoping study were based on lmax. But seems like dorfner are quite competative, so hopefully can reach similar numbers.
