Mt Holland contains Gold, Lithium and Tantalum. It's value goes beyond what MZN seek. What Mt Holland is worth now would be irrelevant to the claim. The MZN offer was for $275K cash equivalent so that's all it was worth in April. And that IMO would be the limit of the claim. eg if I granted you a license to manufacturer a product and you had yet to make or sell a single unit, then are you entitled to claim a lost of profit on a fiction future sales volume? Is a government entitled to claim a royalty or taxes on what's in the ground before a mineral has been economically exploited?
The initial ruling will determine whether or not MZN have a case (Declaratory Relief). This won't mean they've won the case, it will however mean they get the opportunity to spend more money on legals to find out whether the Defendant equally wants to spend more money on legals to continue the fight. The case will follow the case flow management process applicable for the WA Supreme Court. It gets very expensive before any court will issue any order. Just speaking from experience,
