The announcement of 23 November said the loan was subject to maintaining sufficient reserves.
It could be said that the announcement of 16 January should have been clearer on this - ie the likely downgrade may put BMO in default of its loan. However, anyone that invested in BMO on fundamentals should have been able to deduce this quite easily.
