No Judgement here but if you are a fundamentally a compassionate society also trying to use some form of logic to achieve a intelligent solution and the defense knew that would you not exploit it.
If you were the defense lawyer wouldn’t you encourage it save your client.
I mean the clown is pretty tied down to guilt what else is left.
Not suggesting the death penalty is the solution only if you didn’t want it considering World events it maybe be in your interests to say you did.
