Because that is how the court works, KDR brought a motion to move the court in a certain direction, MZN objected and lost, and the Jugde awarded costs for that part of the hearing to KDR. Not unusual and you can't read anything into it unless you are completely biased.
As I said just a minute ago this is a win for KDR IMO, but it doesn't stop MZN dragging this out for another 4 months. If KDR decide its best to settle it will cost them millions IMO (possibly 2 or 3 million IMO and everyone bares their own costs) which will put a dent in their cash, not helpful.
Lucky for my reporting or the KDR shareholder mushrooms would be wondering what this split is all about. Many people gave me thumbs up for my court reporting and thank you to those people. Others just attacked me. You know who you are. Pathetic. Esh

The KDR motion to split the trial was a defensive move, they won but you can't read anything more into it than that.
They just eliminated the need to argue the damages claim against them at the same time that the contract case is being determined.
Unless this is settled this is still going to trial in May and the contract case will be determined then.
For KDR it means 4 months of uncertainty or a settlement against them worth millions IMO (ouch). Esh
