My reply was in relation to correcting Tunas claim that contractually TEVA could only walk based on one(1) sole reason/basis. There were three(3) reason / basis ..as written in the 24/9/13 agreement.
The fact is we don't know which one it was...forget about hypothesizing...If you know - x-reference your view to an actual TEVA/MSB release. If the answer was surrogates - this could ONLY have been performed by "the Statistician" - I'm not making this up , please read the agreement.
If the statistician conducted such a review and gave notice to MSB / TEVA - this would have to be reported to ASX / Nasdaq . No such notice was ever given to ASX / Nasdaq.
Make up your own view about CHF / P3 ..I've made up mine.
