Apologies if someone has said this before, but there's so much to troll through.
Having thought about it and read a bit on MOU's, I reckon the most plausible explanation is that the anonymous spokesperson from NAB did not know enough about MOU's and thought that all MOU's were binding.
Since this MOU is clearly not binding, the spokesperson perhaps thought that it couldn't then be an MOU. If this is the case, then the problem disappears, except for all the stress and embarrassment.
