Further information has been gleaned from the UK and Hong Kong trade mark applications, which make it reasonably clear that the
MAGNEMASKS is associated with OBJ technology, perhaps even for use with a Wave II or Wave III device (.e.g the
MAGNETIC BOOSTER?). In particular, I draw attention to the description of the goods associated with the
MAGNEMASKS (UK) and
OLAY MAGNEMASKS (HK):
- MAGNEMASKS (UK): "...magnetic applicator for applying skin care preparations; magnetic applicator for facial cleansing"
- OLAY MAGNEMASKS (HK): "...magnetic applicator for applying skin care preparations; magnetic applicator for facial cleansing"
I note that the expression "magnetic applicator" has not, until now, been used by Procter & Gamble in relation to any other trade mark application device descriptions we have discovered (i.e.
MAGNETIC BOOSTER,
MAGNETIC POWER INFUSER, and
SK-II MAGNETIC WAND only ever referred to "skin care" devices, and we have been left to infer from the name of the trade mark that it was an OBJ magnetic technological device). I don't think there's any room for doubt now, in light of the above descriptions - it's clearly OBJ related.
Finally, I make two further observations about the
MAGNEMASKS (UK) trade mark application:
- This would appear to be the first OBJ-technology-related trade mark application that Procter & Gamble has filed in the United Kingdom. The SK-II MAGNETIC WAND trade mark application is the only other European trade mark, which was filed in the European Union intellectual property office (not the UK) on 26 September 2014 (see below). I put the UK vs. EU issue down to the fact that the UK is now in the process of leaving the EU.
- However, perhaps more importantly, note that the EU trade mark application for the SK-II MAGNETIC WAND was filed on 26 September 2014, literally a few days before P&G (and OBJ) formally announced the commercial launch of the SK-II wand. As we have seen with the Asian nation trade mark applications filed in the last 6 months (MAGNETIC BOOSTER, MAGNETIC POWER INFUSER, and MAGNETIC MICROPULSE TECHNOLOGY), the time of filing has not, at least in recent times, been an immediate precursor for commercial launch. But can the same be said in relation to the UK MAGNEMASKS trade mark application? See how all the other countries filed their SK-II MAGNETIC WAND trade mark applications back in September/October 2014, within days of the EU filing theirs? Does that mean our 6 April 2017 filing date for MAGNEMASKS in the UK is an indicator that other nations will be filing on Monday, and commercial launch of the OLAY MAGNEMASKS (with, perhaps, the MAGNETIC BOOSTER) is imminent? Of course, one can only speculate, as I have made this sort of observation in the past, with nothing coming of it. However, I certainly won't be selling any OBJ shares on Monday or any time soon for that matter.
