The "speak English" part of this is quite problematic. For example I know two Sikhs from India who had to redo the existing English language test for permanent residency despite holding tertiary qualifications from India achieved in English (one in pharmacy the other in economics). The basis of their initial rejection was accent...they can be difficult to understand, but their accents aren't markedly more problematic than some people from Scotland or parts of Northern England.
