MZN seemed to want to give sufficient doubt in so much as a contract of sorts was formed between their nunerous texts and emails.
However, and much credit to Donaldson for this, he brought the dfence case back to the actual MZN plea which was that a contract was formed on 4th April and which as a written instrument is acknowledged to never exist. Texts and emails went on beyond 4th April.

My only worry is that there is no doubt that there was an intent to deal by MD.

Different laws, but, I can go out onto the streets with the intent to murder someone but if I don't kill them you can't charge me with manslaughter let alone murder.

As was said by Donaldson, no doubt MD wanted to "knock this over and move on" but it was never knocked over, not even close
