I can't see any consequences given that they have now clearly represented that they won't be claiming them - the cost accounting for it will simply be reversed as Pman has suggested.. There's therefore no "damage" arising from whatever any of us might say about being misled by the Annexure E and so it's as if the Performance Milestone #2 was never there.
