Yes, as I wrote already, my bad. The law was changed in 2014 (between others by Babis) and so former agents like him can become ministers now. Exactly as you wrote, the court declared lower court decision as invalid which makes Babis agent again. Unless he will prove himself otherwise.
On Wednesday government rejected ANO party proposal to make MOU void. On Monday there will be special session in Senate where ANO party has small minority so whatever they will cry about it does not really matter. By the way the upcoming elections won't change anything about Senate, it is (only) for Chamber of Deputies.
Anyway the major outcome is EMH has full rights on resource and by law everything EMH mines out is property of EMH. Czech government is now thinking hard about how they can enter the project and make the Czech Republic more involved. The government commissioned the Minister for Industry and Trade to look more into these options.
