You show you have a very poor understanding of the deal
My understanding of the situation is the deal allowed for a minimal royalty to be paid on tonnage which is low but upon 25000 tonnes being shipped a fee of $40m USD was also and separately payable for the mine, a further $40m USD is payable after 1 m tonnes is shipped.
I think the deal is clear and so is the fact BRL have admitted they have mined and moved over 25000 tonnes to stock piles.....what is not clear is the definition of the word shipping in this sector or more broadly hence why we are in court.
If does appear, as you have said, BRL are relying on the courts to be sector pacific about the interpretation of the word shipping which seems to me to be a little precarious given does anyone even know what that is.
After researching the word shipping myself I can see why the claimant would be very confident of winning.
