I didn't say that Simms is out, but certainly not in control or on proposed board. Simms is still, I think, about the 3rd largest shareholder and knows the technology inside out.
As to your second question, I don't see a problem with that. There is the question of the dormant legal dispute which has cost both sides considerable sums of scarce financial resources. Wihout going into the rights or wrongs (I know we both hold different perspectives), neither party is in a position to continue to enrich lawyers via the dispute process. Any agreements hence forth by MSO for use of its technology will be on non-exclusive terms (unless the deal is huge), so it might make perfect logic to leave the past behind & start a fresh. I would suggest that neither JK or TS be involved in discussions however.
