The drug allegations- charged then dropped- will now have a major bearing on the validity of the request to ask for a person to give a blood test.
You cant just ask for a blood test without good reason, what was theirs could be asked?
This law which is only 2 days old in WA has never been tested in court, but apparently there are many hurdles for the police to get through to make the charges stick regarding not taking a blood test..
WA Police may infact be sued under the "Malicious prosecution" provisions.
