I think the central issue is one of disclosure, that is, if the issuance of the shares were part and parcel of the agreement, why was this not disclosed at the time. This is the main line of investigation underway by the AFR and ASX at the moment. It will be interesting to see how the ASX approach this given one of their own is connected with FCC.
