The AFR alleged the crimes occurred in Victoria and were likely state crimes. There is no spent conviction legislation in Victoria for crimes under the crimes act (unlike NSW). The AFR allege Evertz was found guilty and sentenced to 8 months gaol, 7 months suspended. I am no expert but usually if they send you to gaol they record a conviction.
So if he was ever convicted in Victoria under the crimes act , the conviction cannot be erased. It may not show up on some criminal background checks due to age, but I thought it probably should.
Something is wrong, either AFR or the press release.
Also, if i wanted to reassure a market, I would engage an experienced company director, one who had many years board experience, probably on internal audit committees.
Based on my limited experience with compliance in Russia, I would not regard that experience as strongly related to best practice in corporate governance. I remember a boss of mine disappearing for a few weeks, only to resurface after shutting down our company's whole russian arm. Didn't sell it or liquidate, just got rid of it at a large loss and not going back. That was because under US law, the US directors and execs of the company were legally responsible for the illegal things the Russian arm was doing. It couldn't be saved, just terminated. And they were a well known business selling to government/quasi government businesses.
Not everyone is Russia is bent, but in my 15+ years in governance I am yet to hear a good story out of there.
Now if I wanted someone who could look the other way......
