    There's never a real winner, The Judges are familiar with these types of disputes, it's an award system, each party are awarded concessions against claims.
    The contract will be closely scrutinized and "were all of the terms adhered to" by Both Parties.
    My take is it could come out Neutral or damn close to it, Pybar will be clearly be owed some compensation for the previous months work, just not $9m. I'm not saying that Pybar were asleep at the wheel or negligent in maintaining or repairing of machinery so it was operating at optimal capacity....but some might...
    What the wider market hasn't grasped is that WPG disputed the Invoices, so then decided to with hold payment, WPG have not defaulted in anyway,,, from the knee jerk reaction at the time it seemed Pybar implied WPG may not be in the position to have settled the Invoices, Forensic accountants will easily see if that was true at that time,,,
    Management got themselves and the company in a tricky spot, nothing new, possibly by being to confident in the previous contractors ability?
    Over the past 3 months WPG has conducted themselves in a truly professional manner, meeting all regulatory reporting deadlines with clear concise explanations..
    Now we just need truckloads of Bullion to pay back our financier, shouldn't be to hard if they are hitting xx? grams per tonne
