Sorry Christian I don't agree with your conclusion that there is no risk to shareholder plaintiffs.

Consider the position if the case gets underway and big costs are run up on both sides and then ILF/ILH goes broke or invokes the 7 day opt out rule or in some other way stops funding the case. I agree with what you say in points 1, 2 and 3 of 196172 but what about the defendants costs.

If the case stops because the plaintiffs funding stops, then judgment and costs go to the defendant and that means the plaintiff shareholders could be called upon to pay the defendants costs.
