Spiderman, Im not so sure that CHM would be fussed if MMX drew out the claim for years, especially if CHM is granted an injunction on any transaction of the tenements in question until it is sorted out. (i.e thus blocking the mitsubishi deal.) I'd say MMX would want to sort it out as quickly as possible!!
