I'm sure neither side wants to go to trial & pay excessive legal fees.
The figure of $39m, i believe it was, is a starting point for negotiation.
I'm sure the supplier will have insurance to at least partially cover these situations so i'd expect it not just a $39m or nothing situation.
I don't think anyone expects the pretrial negotiations to result in an offer anywhere near the $39m, the question is whether the offer will be acceptable to CSS?
I would have thought they'd settle for half what they're asking for to avoid going to court, $20m would increase production a long way.
