They have now breached ASX Listing Rules 17.5 "Failure to lodge Documents"

    Here it is:

    17.5
If an entity fails to give the ASX documents required under Rules 4.1, 4.2,4.2A, 4.3, 4.3A, 4.4, 4.4A 4.5, 4.7B, 5.1, 5.2 or 5.3 or the annual report required under rule 4.7, ASX will suspend its securities from quotation on the trading day after that date on which the documents were due. ASX will not waive this rule"

You see, MFS tried to get them to Waive the rule....but failed.

There is a bigger problem though that MFS will now have with the ASX.

    Rule 17.12
Removal from the ASX not at entity’s request.
“ASX may at any time remove an entity from the official list is, in ASX’s opinion, any of the following applies.
    • The entity is unable or unwilling to comply with, or breaks, a listing rule.
    • Some other rules also”

    So there you have it.

MFS’s in-ability to comply with the ASX and being denied a waiver even though ASX never waives the rules above means they may not just be suspended from the ASX but not allowed to list again.

I am honestly starting to think it is MFS’s intention to not relist on the ASX.

The releasing of the financial results should have been the highest priority if MFS believed they would one day relist on the market.
