Regarding 'the case would have been thrown out long ago' if it didnt have merit -
I dont think the ICC even has the ability to throw cases out if it wants to, from what I have read on the ICC process they have to consider each case accordingly and deliver a verdict.
FAR's case has hasn't even reached TOR (that we know of) so the arbiters haven't even had all of the info, let alone time to consider it all, to allow them to throw the case out (if they could), make a quick decision or otherwise.
I believe FAR has a case, I am just pointing out that it is a risk to rely on the fact that the case hasn't been thrown out to back up the assertion FAR has a case, when the case probably couldn't be thrown out anyway and they aren't even up to a stage where they could make that call anyway.
