    Euro,
You may be right that Opes put out different versions of their contracts but then answer me this, HOW could ANZ or any other entity for that matter sell your, or my, shares in my name if I didn't give them title to them at some point in time?

No-one can sell your house, car or any other asset without you having to agree to it and signing a transfer paper, or placing an order electronically. The CHESS system electronically records all share transactions, and all companies through the brokers reciever shareholder advice notices to whoever is maintaining their share registry.

The cannot just up and sell something out of thin air.

There MUST be some instrument that changed hands either physical or paper that demonstrates that the transfer took place.

The administrators called in by Opes directors don't have any doubt, the Recievers for ANZ and the other 2 banks didn't have any doubt and now the court also doesn't have any doubt.
