well I am not so sure that "passing the title" per se is the key factor for capital gains.
When Joe Blow goes out and buys an investment home unit with a mortgage loan ( hardly an exotic transaction ), the bank holds the title to the property , but when Joe goes to sell it in ten years his CGT is worked out on the basis that Joe owned it.
