FAS advised that it "announced" the loan by including it in the accounts, it did not advise of the lender, the security or the deal. Had FAS NOT included the loan in the accounts the directors would have committed fraud and the auditors would have haemorraged.
Fas therefore has not advised the market- what is the penalty for a breach- and if there isn't one why do companies bother?
