well my opinion is that the stock lending princple will be upheld by the courts. The mortgage argument will fail. But ANZ"s last minute charge over all the asets wll be overturned. That just MY VIEW of the most probably outcome.
The securities lending effectively precluds the actual return of shares.
Arguments of fraudulent misrepresentation would probably succeeed against Opes directors but it will be a pyrrhic victory as they will be broke. They probably wont succeed against ANZ.
Thats all just my "most probable" opinion.
