The issue is innocence or guilt. The weight of social context should not influence fairness in a court of law. Justice should be blind to anything but the search of truth in a case. Nothing but the factual evidence should be admitted in a court that seeks the application of justice.
The onus is on the prosecutor to prove guilt of the defendant, not the other way round; nor to weigh the wider social or political contexts of the case.
