Had a few hours to kill tonight so I did some reading of PAR’s patents and honed in on the US one(s) relating to BME and OA. In reality, the Japan and Europe ones are almost verbatim.
interesting findings. Original patent relating to PPS treating BME was submitted in 2012. The most recent patent that is approved was submitted in 2015. An amendment, that is still pending was submitted in late 2017. The pending status is well within grant timelines and there is currently no legal challenge.
You have to remember that originally the aim of PAR was to treat BME’s related to sports injuries. The effects in OA probably even surprised PAR. What I read in the latest amendment - is a tightening up of BME being causal to OA. In the 2015 submission, OA was hardly mentioned. In the 2017 submission, a lot of invention clauses relate to BME affecting surrounding subchondral bone, cartilage etc in the lead up to OA.
I note 2 very interesting points.
1) The patent covers all derivatives of PPS, including variations in salts (ca, mg, na), and like derivatives including heparin. They name Bene’s formulation as preferred. Dosage is described in detail and forms the backbone of the invention. Patent ends in 2032.
2) it actually covers BME in all forms - in all mammals. Yep - including use in cats, dogs, horses, even zoo animals. I put it down to legal strategy here.
