I replied in connection to your post applying the rule to the oppies. So in that scenario, as I replied it looked mighty silly for the ASX to apply any sort of consolidation as the impact on the SP was astronomical compared to “what can possibly be achieved?” by enforcing such a steep consolidation driven by 1% of SOI.

Do note though the CR was at 2.4c associated with the July announcement so that part is eliminated. The previous 20 trading days sub 2c I agree with. So that captures WFE to the 20c rule “if” it’s applied. Just another task to do while currently suspended if the ASX chooses to apply the rule, albeit I don’t see what it will achieve. A 9 to 1 consolidation is more reasonable if imposed and not out of the question if the tough stance continues.

I don’t believe applying the 20 cent rule is a must if the ASX chooses to not apply the rule at all, hence applying for dispensation is not required either. I draw your attention to the part that says can impose in the rule, rather than saying “the ASX will” or the company “shall” or “will” or “must” comply with the 20c rule. So the application of the rule is at the discretion of the ASX.

The ASX recognises that when an entity's securities have been trading on the ASX at less than 20 cents.......... can impose structural, timing and other impediments to the completion of a transaction that otherwise might be in the interests of an entity and its security holders.”

Hence why imo some guidelines like the 20 cent rule appear to be written for the ASX to apply rules as they choose rather than a list of rules for a company to follow and comply with. So on that basis the ASX at their discretion can decide the 20 cents is not to be imposed on the basis it won’t achieve anything to the benefit of holders or the entity. Or they can choose to impose it.

IMO for new listings 20c is a good standardised starting point.
