Shareholders should be generally much more proactive. If a class action is a possibility given by a country’s law then contemplating the possibilities or opportunities that arise with it is not lawlessness.
Admittedly, a company which has to fight a class action is always distracted and needs to commit and divert funds and resources away from the core business.
The majority of holders is afraid of such a move, agreed. But there are many cases were class actions settled in favour of shareholders. This of course works only when there is still loot to be spread, if a company is already belly up this doesn’t make any sense anymore.

As for our case: there are a lot of holders 10 years and longer which feel that time is running out. It just needs seven really disgruntled LTHs to start something like this. The magnificent seven.
