    It is possibole but, again from my experience, because I asked this, however it related to a trade mark issue, this is extremely unlikely.

    They are not often all that willing to exercise their full power, as this can lead to appeal points that can overturn a decision.

    This will go either all the way to the full bench of the fed court at least or to an out of court settlement.

    Incidently, someone esle just posted about CNP being insured. The class action will hit strongly on the point of negligence of directors or some such thing. Negligence would not really be covered by directors insurance as it is not covered under many indemnity type policies. But I could stand corrected in this.

    Since this was raised, here also is another question, if CNP has claimed on their insurance pre-emptively, would they need to disclose this to the market? It is material, but it would prejudice the directions hearing i'm sure...
