Well the case is solely focussed on the economics of TPG rolling out a fourth network. TPG just needs to prove they can't afford it and given the costs involved, that shouldn't be too hard.
Only problem is there are apparently documents floating around which suggest TPG would re-start plans to build a network if the ACCC rejected the merger. I doubt Teoh would have been that sloppy. There was an article in the AFR on it in May. "ACCC needs smoking gun on merger block"
