I think you you saying VMC's case is also based on email communications?
Thus far I have not seen that interpretation. However if you are correct, I would certainly think VMC has a very weak case.
I certainly hope VMC's case is more substantive with actual signed documents and payments for services. If the latter then the case cited is largely irrelevant.
