Hi Love islander, now you are just making that up, the section states nothing of the sort., it only requires an agreement. Your example would be one form of agreement but it doesn't mean other agreements would not be included.

Anyway, here is an example of a group of shareholders who lodged a 249D notice on another company and the filling in of the required Substantial holder notice form. If you go to section 6 you will see the "nature of association" listed quite clearly.

Also , interestingly the same definitions of "associate" etc are used under the takeover provisions of the Corporations act.
